Terms of Service

These Terms of Service are the agreement between you and Msafiri for listing and operating adventures, tours and experiences through the Msafiri Agent app. They set out your status as an independent operator, the licensing, safety and guide standards you must meet, how commission and payouts work, and the conduct rules that keep travellers and staff safe.

Zero tolerance

Zero tolerance for sexual harassment, sexual assault and violence

Msafiri has no tolerance for sexual harassment, sexual misconduct, sexual assault, physical violence, threats, stalking or intimidation — by or against travellers, agents, guides, drivers, porters, crew or our staff. This applies on every experience, at meeting points, in transit, at overnight camps and lodges, in in-app messages and calls, and in reviews. A single substantiated report is enough to permanently remove an account and every listing on it.

Unwanted sexual comments, advances, propositions or requests for a traveller's personal contact details
Any unwanted touching, indecent exposure or non-consensual sexual contact, including by a guide or crew member
Photographing or recording a traveller in a private context, or sharing such material
Physical violence, assault, threats of harm, brandishing a weapon or intimidating a traveller
Exploiting the isolation, dependence or intoxication of a traveller on a remote or overnight trip
Retaliation against anyone who reports a concern in good faith or assists an investigation

If you are in immediate danger, contact local emergency services first, then report to us through the in-app safety option. Reports are handled confidentially by trained staff and we never require you to face the other person.

04Eligibility, Business Registration & VerificationBusiness details, KYC and the screening we require before activation.

05Licences, Permits & Guide CertificationThe operating authorisations your specific activities require.

06Listing Accuracy & ContentFull disclosure of itinerary, risk, fitness demands and exclusions.

07Safety Management & Risk AssessmentYour primary safety duty, briefings, ratios and emergency planning.

08Guides, Crew & SubcontractorsYou remain responsible for everyone who delivers your experiences.

09Traveller Screening, Health & MinorsEligibility checks, medical disclosure and rules for minors.

10Availability, Confirmations & Honouring BookingsKeeping capacity accurate and delivering what was booked.

11Cancellations, Weather & RefundsYour policy, safety cancellations and operator-cancellation consequences.

12Agent Conduct & Professional StandardsHow you and your staff must treat travellers.

13Zero Tolerance for Sexual Harassment & ViolenceProhibited conduct and immediate permanent consequences.

14Reporting & Enforcement of Safety ViolationsHow reports are handled and the consequences that follow.

15Non-Discrimination & AccessibilityYou may not refuse or downgrade service on discriminatory grounds.

16Pricing, Commission & PayoutsHow your earnings are calculated, released and recovered.

18InsurancePublic liability cover is mandatory; what Msafiri does not insure.

19Environmental, Wildlife & Community StandardsConservation rules, wildlife conduct and community respect.

20Reviews & Your ContentReview integrity and the licence you grant us for listing content.

21Traveller Data & PrivacyYou may only use traveller data to deliver that specific booking.

22Intellectual Property & Brand UseLimited licence to use the app; restrictions on our branding.

23Prohibited ActivitiesFraud, platform circumvention and unlawful operation.

24Suspension, Removal & AppealsGrounds for action, your right to appeal, and confirmed bookings.

25DisclaimersThe platform is as-is, with no guarantee of bookings or income.

26Limitation of LiabilityExcluded losses and the cap on our liability to you.

27IndemnificationWhen you cover claims arising from your operations.

28Dispute Resolution & Governing LawRaise it with support first, then mediation, then proceedings in Kenya.

29General ProvisionsSeverability, assignment, entire agreement and force majeure.
